The legal basis for CE marking in the construction sector is the EU Construction Products Regulation (Regulation (EU) No. 305/2011), which uniformly regulates the conditions under which a construction product may be placed on the market. The aim is to remove technical barriers to trade within the EU and to ensure a high level of product safety.

What does the Construction Products Regulation specifically regulate?
  • The Declaration of Performance (DoP) is the central document: it describes the essential characteristics and expected performance of the construction product.
  • The CE marking itself refers to this declaration of performance and shows that the product has been manufactured in accordance with the declared performance and using harmonised technical standards.
  • For many products, the application of harmonized standards is mandatory - for others there are alternative evaluation procedures.

Harmonised standards: the road to market authorisation
The CE marking is closely linked to harmonised European standards (hENs). These specify specific requirements that manufacturers must meet - for example on load capacity, fire resistance, thermal insulation or sound insulation.

The CE marking process

The path to the legally compliant CE marking is divided into several steps. Depending on the product group and classification in the risk classes, the effort may vary.

  1. Classification and identification of the construction product
    First of all, it is determined whether the product is covered by a harmonised standard or a European Assessment Document (EEAS) is required.
  2. Performance evaluation
    Depending on the system for assessing and verifying constancy of performance (AVCP), Tests by notified bodies are required.

Obligations of the manufacturer for CE marking of construction products

As a manufacturer of construction products, it is advisable to observe certain obligations in connection with the CE marking in advance. This includes the preparation of a declaration of performance (also DoP) in accordance with the Construction Products Ordinance and the affixing of the CE marking to the product as a sign of conformity with the applicable standards. Without a declaration of performance, the affixing of CE markings is not permitted. In addition, the technical documentation and the declaration of performance should be kept for at least 10 years. To ensure product quality, appropriate procedures should be put in place to continuously verify declared performance in series production. This includes spot checks and documentation of complaints and product recalls. In addition, it is advisable that the construction products carry an identification mark and contain information on the manufacturer's identity as well as instructions for use and safety information. In the event of non-compliance, immediate corrective action should be taken and national authorities should be informed immediately.

What is the difference between Ü-mark and CE-mark?

The CE mark on a construction product indicates that the product complies with the Construction Products Regulation and other European requirements and can therefore be placed on the market in the European Economic Area.

The Ü mark identifies a construction product that meets additional requirements applicable in Germany and can therefore be installed in Germany. However, it is foreseeable that the Ü mark will disappear some time ago, as the European Court of Justice called on the German legislature to harmonize the requirements in 2014.

As a manufacturer (or distributor), how do I obtain the CE marking for my construction product?
